Evolution Well Succeeds in Challenging BJ Energy Fracking Patent

Evolution Well Services LLC defeated parts of a fracking equipment patent in a new tribunal decision after the patent’s owner, BJ Energy Solutions LLC, accused it of infringing in a federal lawsuit in Texas.

The Patent Trial and Appeal Board ruled Wednesday that BJ’s asserted parts of its US Patent No. 9,395,049 regarding a mobile hydraulic fracturing fluid delivery system are unpatentable. The parallel litigation in the US District Court for the Southern District of Texas was stayed last year pending the PTAB proceeding.
